Campus Code of Conduct

(A)  Prohibited Behavior: LCCC students, faculty, staff and campus visitors are prohibited from engaging in, participating in, or aiding and abetting activities or actions that are in violation of any federal, state, or local law or ordinance. The following list contains examples of behavior subject to disciplinary action and/or other action by college authorities. Appropriate disciplinary action may include ejection from college property, suspension, expulsion, or dismissal so that law and order can be maintained and the college may pursue its educational objectives and programs in an orderly manner. The list is not meant to be exhaustive or exclusive.

1.  Obstructing or disrupting teaching, administration, disciplinary procedures, or other college activities including the college's public service functions or other authorized activities on college owned or controlled property.

2.  Rioting or inciting others to riot.

3.  Physical or mental abuse, detention, or conduct, which intentionally or recklessly endangers the health or safety of any person on property owned or controlled by the college, or at any college sponsored or supervised function.

4.  Theft of or damage to college property or the property of others on college premises including all computer programs, data and access to them or unauthorized possession of such property.

5. Obstructing or impeding pedestrian and/or vehicular traffic on college property.

6.  Using, possessing, selling or distributing illegal drugs, narcotics, marijuana, and drug paraphernalia on college owned or controlled property.

7.  Consuming, possessing or selling alcoholic beverages on college owned or controlled property except during college approved activities.

8.  Disorderly conduct, public intoxication, or lewd, indecent or grossly inappropriate conduct or expression while on college property.

9.  Unauthorized possession or use of firearms or other potentially dangerous weapons, explosives, combustibles or dangerous chemicals; or the possession of any other objects with the intent to damage, injure or disrupt college activities on college property or at an off-campus college sponsored activity.

10. Failing to comply with directives of college officials or law enforcement officers acting within the scope of their duties, or failing to identify oneself when requested to do so by Campus Services officers or law enforcement officers while on college property.

11. Gambling while on college property.

12. Unauthorized entry to or use of college facilities, including buildings and grounds.

13. Selling or promoting the sale of goods or services on college owned or controlled property. Exceptions include recognized organizations with permission from an appropriate college official.

14. Verbal, physical, or sexual harassment or intimidation of a student, visitor, faculty or staff member including any abuse, signs or signals intended to mock or ridicule race, religion, age, sex, color, disability, sexual orientation, or national or ethnic origin while on college property or participating in a college-sponsored activity.

15. Unauthorized use or alteration of fire alarm or fire fighting equipment or other emergency safety devices while on college property.

16. Interfering with or disregarding emergency evacuation procedures such as willful disregard of a fire alarm.

17. Operating a motor vehicle while under the influence of alcohol and/or drugs or in a reckless or dangerous manner while on college property.

18. Violating the college's parking and traffic rules and regulations.

19. Falsifying or misrepresenting of self or other information to a college office or official.
 
20. Forging, altering, or using college and other documents, records, or instruments, with intent to defraud or furnish false information, or gain unauthorized access or attempted access of college records including all computer data, programs and related files.

21. Making telephone calls to or from the college with the purpose to abuse, threaten, annoy or harass another person.

22. Willfully violating the college's Policies and Procedures.

23. Bringing in or harboring a pet in college facilities without authorization.

24. Smoking in any college building or enclosed walkway.

(B)  Enforcement Authority:

1.  Authority has been delegated to the President and designated as appropriate to Director of Campus Services, Campus Services Officers and others acting within the scope of their employment, to lawfully order violators of rules promulgated in Section A to do one or more of the following:

a. Request the person(s) to cease and desist such activity;

b. Order the person(s) to immediately leave campus property and, upon failure of the person(s) to do so, to request assistance from appropriate law enforcement authorities.

2.  The authority to order persons to leave may be exercised when, in the judgment of the Director of Campus Services or Campus Services Officers, it is reasonable to maintain order to do so.

(C)  Violations and Disciplinary Action:

1.  Charges alleging a student's actions of prohibited behavior as described above are to be filed in writing with the Director of Enrollment Services within fourteen (14) days after the charging party becomes aware of the alleged offense.

a.  Upon receipt of a written charge filed against a student, the Director of Enrollment Services will convene the Committee on Student Conduct to review the matter and recommend appropriate disciplinary action.

2.  Charges alleging an employee's actions of prohibited behavior as described above are to be filed in writing with the Director of Human Resources within fourteen (14) days after the charging party becomes aware of the alleged offense.

a.  Upon receipt of a written charge filed against a non-faculty employee, the Director of Human Resources will initiate action to address the charge in accordance with Procedure III-731: Complaints, Problems, Grievances by Non-Faculty.

b. Upon receipt of a written charge filed against a faculty employee, the Director of Human Resources will initiate action to address the charge in accordance with Policy II-234: Faulty Senate Committee on Problems.

3.  Charges alleging a campus visitor's actions of prohibited behavior as described above are to be filed in writing with the Director of Campus Services within fourteen (14) days after the charging party becomes aware of the alleged offense.

a. Upon receipt of a written charge filed against a visitor, the Director Campus Services will thoroughly investigate the complaint to determine if a violation has occurred.

b. If the Director of Campus Services determines that a violation has occurred, the visitor involved will be advised in writing of the finding and any disciplinary action imposed.

c. A visitor may request an appeal hearing with the Vice President for Administrative Services by filing a written request with the Office of Vice President for Administrative Services within 14 days from the date on the written notice of the findings.

d. Upon receipt of a written request for an appeal hearing, the Vice President for Administrative Services shall set a date for the hearing and shall give the party requesting the hearing at least 3 days notice of the time and place for the hearing.

e. At the hearing, parties will have the opportunity to hear the nature of the complaint, present evidence and witnesses, ask questions and refute allegations.
 
f. All hearings will be closed to the public unless all parties agree to an open hearing.

g. The Vice President for Administrative Services will preside over the hearing and shall have the authority to exclude irrelevant or repetitive evidence or testimony.
 
h. The decision of the Vice President for Administrative Services shall be issued in writing within ten (10) days after the hearing.
